Terms and Conditions for Presale Ceramic Items 

These terms and conditions govern the presale of artworks offered by Wa Melbourne Ikebana Festival, hereinafter referred to as "the Seller," to the customer, hereinafter referred to as "the Buyer."

1. Presale Agreement: 1.1 By purchasing artworks through presale, the Buyer agrees to abide by these terms and conditions. 1.2 The presale period shall be defined as the duration before the official release of the artwork for general sale.

2. Payment: 2.1 The Buyer agrees to pay the full purchase price of the artwork during the presale period. 2.2 Payment methods accepted include credit cards and mobile wallets such as Apple Pay, Google Pay, and Samsung Pay. 2.3 Failure to make payment within the specified time frame may result in cancellation of the order.

3. Delivery: 3.1 The Seller shall provide an estimated delivery date for the artwork. 3.2 Delays in delivery may occur due to unforeseen circumstances. The Seller shall communicate any such delays to the Buyer promptly. 3.3 The Buyer shall not collect the item prior the end of the Wa Melbourne Ikebana Festival 2024. 3.4 Thee Buyer must collect the purchased item(s) during the designated time and location at Abbotsford Convent as described at sale.

4. Artwork Description: 4.1 The Seller shall provide accurate descriptions and images of the artworks available for presale. 4.2 Minor variations in color, texture, and appearance may occur between the provided images and the actual artwork.

5. Cancellation and Refunds: 5.1 The Buyer may cancel the order and request a refund within 3 days of the presale period ending. 5.2 Refunds shall be issued in the original form of payment. 5.3 After the specified cancellation period, all sales shall be considered final, and no refunds shall be issued except in cases of proven damage or defect upon delivery.

6. Ownership and Copyright: 6.1 The Buyer acknowledges that the artwork remains the property of the Seller until full payment has been received. 6.2 The Seller retains all copyright and intellectual property rights to the artwork, including the right to reproduce, distribute, and display the artwork for promotional purposes.

7. Limitation of Liability: 7.1 The Seller shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from the purchase or use of the artwork. 7.2 The Buyer agrees to indemnify and hold harmless the Seller from any claims, damages, or losses resulting from the Buyer's use or misuse of the artwork.

8. Governing Law and Jurisdiction: 8.1 These terms and conditions shall be governed by and construed in accordance with the laws of [your country or state]. 8.2 Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts in [your jurisdiction].

9. Amendments: 9.1 The Seller reserves the right to amend these terms and conditions at any time. Any such amendments shall be effective immediately upon posting on the Seller's website. 9.2 It is the Buyer's responsibility to review these terms and conditions periodically for changes.

10. Acceptance: 10.1 By participating in the presale and making a purchase, the Buyer acknowledges that they have read, understood, and agreed to these terms and conditions.
